Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and TortugaApps ("we," "us," or "our") governing your access to and use of the TortugaApps mobile applications (collectively, the "Apps") and our website at tortugahub.app (the "Website").

By downloading, installing, accessing, or using any of our Apps, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Apps.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to create an account and use our Apps. If you are under 18 (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By using the Apps, you represent and warrant that you have the legal capacity to enter into this agreement.

2. Description of Service

TortugaApps provides a suite of mobile applications that use artificial intelligence to analyze images and provide identification results, characteristics, and categorization. Key features include:

• AI-powered object identification from camera photos or image library
• Structured analysis results with characteristics, categories, and contextual information
• Scan history management and organizational folder system
• Multi-language support

The specific features and scope of analysis vary by App. Each App targets a distinct subject domain (e.g., plants, insects, gemstones, collectibles).

3. Account Registration and Security

3.1 Account Creation

To use any App, you must create an account using one of the following methods: email/password, Google Sign-In, or Sign In with Apple.

3.2 Your Responsibilities

You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the confidentiality and security of your account credentials.
• Notify us immediately at support@tortugahub.app if you become aware of any unauthorized access to or use of your account.
• Accept full responsibility for all activities that occur under your account.

3.3 Account Sharing

Accounts are personal and non-transferable. You may not share your account credentials with any other person. We reserve the right to suspend accounts where shared access is detected.

4. Free Tier and Usage Limitations

Our Apps offer a free tier with the following limitations:

• Limited free identifications — a fixed number of free scans (typically 3), after which a subscription is required for continued analysis.
• Advertisements — banner and interstitial ads are displayed through Google AdMob.
• Rewarded ads — you may watch a video advertisement to earn one additional free scan.

We reserve the right to modify free tier limitations, including the number of free scans, at any time and without prior notice.

5. Subscriptions and Payments

5.1 Subscription Plans

Premium access is available through auto-renewable subscriptions:

• Weekly — billed every 7 days
• Monthly — billed every calendar month
• Yearly — billed every 12 months

Premium subscribers receive unlimited scans and an ad-free experience. Subscription prices are displayed in the App before purchase and may vary by region.

5.2 Payment and Billing

• Subscriptions are processed through the Apple App Store (iOS) or Google Play Store (Android).
• Payment is charged to your App Store or Google Play account at the time of purchase confirmation.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription rate.

5.3 Cancellation

• You can manage and cancel your subscription at any time through your device's App Store or Google Play account settings.
• Cancellation takes effect at the end of the current billing period. You retain full premium access until that date.
• No partial refunds are issued for unused portions of a subscription period.

5.4 Refunds

Refund requests are handled exclusively by Apple or Google according to their respective refund policies. TortugaApps does not process payments directly and cannot issue refunds. To request a refund:

5.5 Free Trials

We may offer free trial periods for premium subscriptions. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription at the displayed rate. Trial availability, duration, and terms are subject to change.

5.6 Price Changes

We reserve the right to change subscription pricing. Price changes will take effect at the start of the next billing cycle following reasonable notice. Your continued subscription after a price change constitutes acceptance of the new price.

6. User Content

6.1 Ownership

You retain full ownership of all photos and content you submit to the Apps ("User Content"). By submitting User Content, you grant TortugaApps a limited, non-exclusive, royalty-free, worldwide, revocable license to:

• Process your images through our AI analysis pipeline for the purpose of providing identification results to you.
• Store your images and analysis results within your account.
• Display your content back to you within the App.

This license exists solely to enable us to provide the service. We do not claim ownership of your content, and we do not use your images to train, improve, or fine-tune AI models.

6.2 Content Restrictions

You are solely responsible for the content you upload. You agree not to upload content that:

• Infringes on any third party's intellectual property rights, including copyright and trademark.
• Is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable under applicable law.
• Contains malware, viruses, or any other form of malicious code.
• Depicts illegal activity or encourages conduct that would constitute a criminal offense.
• Violates any applicable local, state, national, or international law or regulation.

We reserve the right to remove any User Content that violates these Terms and to suspend or terminate the accounts of repeat offenders.

7. AI-Generated Results — Disclaimer

Our Apps provide AI-generated identification and analysis results. You expressly acknowledge and agree that:

• Results are informational only. AI analysis is not a substitute for professional advice. Do not rely on identification results as professional, medical, scientific, veterinary, legal, or financial advice.
• Accuracy is not guaranteed. AI models may produce incorrect, incomplete, outdated, or misleading results. Identification confidence scores are estimates, not certainties.
• No warranty on results. AI-generated content is provided strictly on an "as is" basis.
• Safety-critical use is prohibited. Do not use identification results for safety-critical decisions, including but not limited to: determining the edibility of plants or mushrooms, assessing the danger of animals or insects, making medical or health decisions, or any other situation where incorrect identification could lead to personal injury, illness, or death.
• Independent verification required. Always verify AI results with qualified experts, particularly for high-stakes or safety-related matters.

8. Prohibited Uses

You agree not to:

• Use any App for any purpose that is illegal or prohibited by these Terms.
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Apps.
• Circumvent, disable, or interfere with any security, authentication, or usage limitation features.
• Use automated systems, bots, scrapers, or scripts to access, query, or interact with the Apps.
• Attempt to gain unauthorized access to our servers, databases, or other users' accounts or data.
• Transmit any content that contains viruses, worms, trojan horses, or other harmful code.
• Use the Apps in any manner that could overload, damage, or impair our infrastructure or interfere with other users' access.
• Resell, redistribute, sublicense, or commercially exploit access to the Apps or any content generated by them.
• Use the Apps to build a competing product or service.
• Remove, alter, or obscure any proprietary notices, labels, or markings within the Apps.

9. Intellectual Property

The Apps, including but not limited to their design, source code, user interface, graphics, icons, logos, trademarks, service marks, text, and all other visual and functional elements (excluding User Content), are the exclusive property of TortugaApps and are protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Apps for personal, non-commercial purposes in accordance with these Terms. This license does not convey any ownership rights.

10. Privacy

Your use of the Apps is subject to our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, store, and protect your personal information. By using the Apps, you consent to the data practices described therein.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• THE APPS AND ALL CONTENT, FEATURES, AND SERVICES PROVIDED THROUGH THEM ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
• WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
• WE DO NOT WARRANT THAT THE APPS WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, NOR THAT DEFECTS WILL BE CORRECTED.
• WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY AI-GENERATED CONTENT OR IDENTIFICATION RESULTS.
• NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE APPS, SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• IN NO EVENT SHALL TORTUGAAPPS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE APPS.
• OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APPS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY UNITED STATES DOLLARS (USD $50.00).
• THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Indemnification

You agree to indemnify, defend, and hold harmless TortugaApps and its officers, directors, employees, agents, and licensors from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of or access to the Apps.
• Your violation of these Terms.
• Your violation of any third-party rights, including intellectual property and privacy rights.
• Any User Content you submit through the Apps.
• Any action taken or decision made based on AI-generated results provided by the Apps.

14. Termination

14.1 By You

You may stop using the Apps at any time. You may delete your account through the App (Profile → Settings → Delete Account). Upon account deletion, your data will be handled as described in our Privacy Policy.

14.2 By Us

We may suspend or terminate your account and access to the Apps at any time, with or without cause, and with or without prior notice, including but not limited to situations where:

• You breach any provision of these Terms.
• Your conduct poses a risk to other users, our infrastructure, or third parties.
• We are required to do so by law or legal process.
• We discontinue the Apps or cease operations.

14.3 Effect of Termination

Upon termination: (a) your license to use the Apps is immediately revoked; (b) you must cease all use of the Apps; (c) Sections 6.1 (to the extent of existing content), 7, 8, 9, 11, 12, 13, 15, and 16 shall survive termination.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

15.2 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at support@tortugahub.app and attempt to resolve the dispute informally for at least 30 days.

15.3 Jurisdiction

If informal resolution is unsuccessful, any legal action or proceeding shall be brought exclusively in the state or federal courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts.

16. General Provisions

16.1 Modifications to the Service

We reserve the right to modify, update, suspend, or discontinue any App or any features thereof at any time, temporarily or permanently, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuance.

16.2 Changes to These Terms

We may revise these Terms at any time. Material changes will be communicated through the App or by updating these Terms on our Website. Your continued use of the Apps after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must discontinue use of the Apps.

16.3 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

16.4 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any term shall not be deemed a further or continuing waiver of such term or any other term.

16.5 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

16.6 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and TortugaApps regarding the use of the Apps. They supersede all prior or contemporaneous communications, proposals, and representations, whether oral or written.

16.7 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of war or terrorism, pandemics, labor disputes, government actions, power failures, internet or telecommunications infrastructure failures, or cyberattacks.

17. Apple-Specific Terms (iOS Users)

If you access or use the Apps through an Apple device, the following additional terms apply:

• These Terms are between you and TortugaApps, not with Apple Inc. ("Apple"). Apple has no obligation to furnish any maintenance or support services with respect to the Apps.
• In the event of any failure of the Apps to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims by you or any third party relating to the Apps or your possession and use thereof.
• Apple is a third-party beneficiary of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties.
